Filings
to Begin April 2 for Fiscal Year 2008 Quota of H-1B Visas
Because April 1, 2007, falls on a Sunday, the first day the United
States Citizenship and Immigration Services ("USCIS")
will accept H-1B petitions to be counted against the fiscal year
2008 H-1B quota is Monday, April 2, 2007.
Important
H-1B Filing Guidelines
This year USCIS seems to have become more strict in reviewing
H-1B petitions. Thus, in order to avoid a delay in processing
and a possible Request For Evidence (RFE), the following requirements
should be attended to at the time of filing.
Update
on Current H-1B VISA Quota Count
The H-1B Visa Reform Act of 2004, which took effect on May 5,
2005, changed the H-1B filing procedures for FY 2005 and for future
fiscal years. The Act also makes available 20,000 new H-1B visas
for foreign workers with a Master’s or higher level degree from
a U.S. academic institution.
USCIS
Issues H-1B Filing Guidance
USCIS will begin accepting filings for the FY2007 H-1B cap on
April 1, 2006. In anticipation of this event, USCIS is reminding
the public of important regulatory requirements. H-1B petitioners
should keep this emphasis in mind as they prepare petitions in
order to avoid delays in processing and possible Requests For
Evidence (RFE).
Investment
In The U.S. to Obtain Green Card
To promote job creation and encourage foreign investment in the
U.S., 10,000 immigrant visas are available each year to qualified
individuals seeking permanent resident status on the basis of
their investment in a new commercial enterprise. This category
of visa provides the most flexible path to a “Green Card”.
